Morphee Terms of Service

This document defines the contractual relationship between Morphee and its users (GDPR Art. 6(1)(b) lawful basis). It must be reviewed by qualified legal counsel before being presented to users at sign-up.

1. Acceptance of Terms
By creating a Morphee account or using the Morphee application, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Morphee.
These Terms form a contract between you and [Legal entity name] ("Morphee", "we", "us", "our").
2. What Morphee Is
Morphee is a conversational AI assistant designed for groups — families, classrooms, and teams. It provides:
- AI-powered chat and task management
- Group collaboration features (shared spaces, tasks, schedules)
- Optional integrations with third-party services (Google Calendar, Gmail)
- Local-first, privacy-respecting data storage
Morphee is provided as a software application. You may use the hosted service or self-host it on your own infrastructure.
3. Eligibility
3.1 Age Requirements
- You must be at least 13 years old (or the minimum digital consent age in your country) to create an account.
- Users under 16 in the EU (or applicable age in your jurisdiction) require verifiable parental consent before account creation.
- Morphee may be used by minors with a parent or guardian account in the same group who has granted consent.
3.2 Account Responsibility
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Ensuring that any minor you add to your group has appropriate parental consent
4. Acceptable Use
4.1 You May
- Use Morphee for personal, family, educational, or professional purposes
- Connect your Google Calendar or Gmail accounts with explicit consent
- Create groups and invite others
- Self-host Morphee on your own infrastructure
4.2 You May Not
- Use Morphee to process data you are not authorized to process
- Attempt to reverse-engineer, scrape, or bypass Morphee's security measures
- Use Morphee to send spam, harass others, or engage in illegal activities
- Share your account credentials with unauthorized third parties
- Use Morphee to upload or process special category data (health, political, religious data) in chat conversations without appropriate safeguards. Note: Morphee's built-in biometric authentication (face/voice recognition for child identity verification) is processed locally on your device under GDPR Art. 9(2)(a) explicit consent — this is distinct from user-uploaded content
5. AI-Generated Content
5.1 Nature of AI Responses
Morphee uses large language models (Claude by Anthropic) to generate responses. AI responses:
- Are generated automatically and may contain errors, inaccuracies, or outdated information
- Do not constitute professional advice (legal, medical, financial, or otherwise)
- Should be verified before acting on them for important decisions
5.2 Your Responsibility
You are responsible for how you use AI-generated content. Morphee is not liable for decisions made based on AI responses.
5.3 Data Sent to AI
By using the chat feature, you consent to your conversation content being sent to Anthropic's Claude API to generate responses. See our Privacy Policy for details. You can withdraw this consent at any time in Settings > Privacy.
6. Data and Privacy
Your privacy is governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
Key points:
- You own your data. We process it only to provide the service.
- You can export all your data at any time (Settings > Export My Data)
- You can delete your account and all associated data at any time (Settings > Delete Account)
- We do not sell your data to third parties
7. Groups and Multi-User Access
7.1 Group Administrators
Group administrators (owners/admins) may:
- Invite and remove members
- View and manage group-level data (tasks, spaces)
- Configure parental controls for child accounts
Group administrators are responsible for managing appropriate access within their group.
7.2 Child Accounts
If you add a minor to your group, you represent that you have obtained and documented appropriate parental or legal guardian consent for that minor's use of Morphee, including consent for AI processing of their conversation data.
8. Third-Party Integrations
When you connect a third-party service (e.g., Google Calendar, Gmail):
- You grant Morphee permission to access that service on your behalf
- The third party's terms and privacy policy apply to data processed by that service
- You can revoke these integrations at any time in Settings > Integrations
9. Self-Hosted Deployments
If you deploy Morphee on your own infrastructure:
- You become the data controller for your users' data
- You are responsible for compliance with applicable data protection laws
- These Terms apply to your use of the Morphee software; Morphee (the company) is not liable for your deployment's compliance
10. Service Availability and Changes
- We aim to provide reliable service but do not guarantee 100% uptime
- We may update, modify, or discontinue features with reasonable notice
- We will notify you of material changes to these Terms through the application
11. Intellectual Property
Morphee's software, branding, and documentation are owned by [Legal entity name]. The application source code is licensed under [License to be determined]. Your data remains yours.
12. Limitation of Liability
To the maximum extent permitted by law:
- Morphee is provided "as is" without warranty of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability to you shall not exceed the amount you paid for Morphee in the 12 months before the claim
Nothing in these Terms limits liability that cannot be limited by law (e.g., personal injury, fraud).
13. Governing Law
These Terms are governed by the laws of [Jurisdiction — to be determined by legal counsel]. Disputes shall be resolved in the courts of [Jurisdiction].
EU users retain the right to bring claims in the courts of their country of residence.
